EVAA BACKGROUND CHECK POLICY

Policy Statement. The Eastview Athletic Association (EVAA) requires background checks every two years (or 24 months) for applicable Volunteers to ensure the safety and well-being of the EVAA community. Individuals failing to timely complete or refresh EVAA Background Checks may be prohibited from continuing their volunteering; individuals who do not pass the Background Check will be prohibited from participation as defined below.

Volunteers requiring Background Checks. All individuals, 18 years of age or older, serving in one or more EVAA roles, including board director, committee member, sport program director, program board member, coach, assistant coach, or other formal EVAA roles directly dealing with children, directly accessing EVAA-related financial information, and/or as deemed by EVAA in its discretion, are required to timely and accurately register for a Background Check, and must pass such Check to commence or continue their EVAA role(s). During volunteer/coach registration, you will be asked to attest to successfully completing this requirement in compliance with this Policy.

Provider. Background Checks are performed by NCSI, LLC—the provider endorsed by the National Council of Youth Sports. This registration process is completed in the SportsEngine platform using the link at the top of this policy. While individuals may be subject to other background checks performed by independent entities (e.g., other sports associations, places of employment, non-profit organizations, etc.), such other background checks will not be accepted because such entities do not maintain data sharing agreements with EVAA, may define disqualifying information differently, or may use different background check methods.

Funding. EVAA pays for Background Checks using its administrative budget, which is funded by an administrative fee included in all EVAA sport registrations.  

Duration of Validity. Background Check results are effective for two years as of the date of final results issuance. Results are valid for an EVAA sport season if the check’s two-year expiration occurs after the season’s start date.

Background Check Components. The NCSI Background Check provides a comprehensive screen, using 20 checks in 50 states, including:

  • In-depth identity verification
  • Name/address trace and SSN validation
  • County criminal records search
  • Statewide search using official repository
  • Multi-jurisdictional database search
  • Sex-offender registry search
  • Re-verification of criminal records
  • Fair Credit Reporting Act compliance

Data Access. Individuals consent to the Background Check via the informed consent statement executed at the time of background check registration. Registration data is encrypted for privacy and Social Security numbers are redacted in all reports. Background Check results are secured and and directly accessible only by the current EVAA President and Board Safety Director to allow for review to determine if results demonstrate any disqualifying information (results information may be shared with certain members of relevant Program/Sport leadership if deemed necessary for results disposition by the EVAA President and/or Board Safety Director).

Disqualification Criteria. An individual’s designation, as noted within the Background Check results, of having been found guilty for any of the offenses listed below (or other rationale as defined below) will result in disqualification from volunteering (dates of determinations of guilt will be measured against the date of Background Check results issuance):  

  1. All sexual offenses, regardless of the amount of time since the offense (examples include, but are not limited to: child molestation, rape, sexual assault, sexual battery, statutory rape, prostitution, solicitation, indecent exposure).
  2. All felonies that constitute crimes against a person, regardless of the amount of time since the offense (examples include, but are not limited to: murder, manslaughter, aggravated assault, kidnapping, robbery).
  3. All misdemeanors that constitute offenses against a person within the past ten (10) years (examples include, but are not limited to:  drug offenses, theft, embezzlement, fraud, burglary, simple assault, domestic violence, hit and run).
  4. All misdemeanor drug and alcohol offenses within the past two (2) years or multiple of such offenses within the past ten (10) years (examples include, but are not limited to:  driving under the influence, simple drug possession, disorderly conduct, public intoxication or possession of drug paraphernalia).
  5. Any offense within the past five (5) years that could be considered a potential danger to children or demonstrates a propensity for violence.  
  6. Any other rationale, without limitations from the above list, subject to the sole discretion and opinion of EVAA leadership authorized to review background check results, that warrants disqualification or limitation from volunteering or participation where it is in the best interest of EVAA’s youth athlete and volunteer communities.

Disqualification Notice and Appeals. An individual deemed by EVAA to be disqualified per this policy will receive written notification of such disqualification, as well as the method for appealing the EVAA decision, within 10 business days of the relevant Background Check results being received by EVAA. Notice sent after this 10-day period will not constitute a waiver of EVAA’s authorization under this policy to disqualify an individual. Notice will be attempted by EVAA by email to the individual’s designated email address from the associated registration (hard copy if requested). Designated members of the relevant sport’s board or leadership will receive notice of EVAA’s decision to disqualify an individual for purposes of rostering updates for that season.

  • The disqualified candidate may request an Appeal Hearing within 10 days of the issuance of the disqualification notice; members from EVAA’s Operations Committee will hear the appeal at the soonest available time, but no later than 10 days from the time the Appeal Hearing is requested. 
  • The disqualified candidate may present information or documentation to the EVAA Operations Committee members to dispute the findings of the Background Check results and make a case for reinstatement or relief from the disqualifications determined per this Policy. 
  • The EVAA Operations Committee members hearing the appeal will issue a decision within 5 days of the date of the Appeal Hearing.
  • Appeal Hearing decisions are final and are not subject to further appeal.
